Terms of Service

Agreement to terms

  1. By accessing or using NursingExamPro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 18 years old to use this Service.
  2. We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a notice on our Service. Continued use after modifications constitutes acceptance of the updated Terms.

Description of service

  1. NursingExamPro is an online exam-prep platform for the Philippine Nursing Licensure Exam (PNLE) and the NCLEX. The Service provides over 10,000 practice questions with detailed rationales reviewed by licensed nursing instructors, organized by official exam categories and topics; short, timed practice tests that produce a blueprint-weighted pass-readiness score; a progress dashboard to track mastery by topic; and a mobile-first experience with progress synced across your devices.
  2. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We do not guarantee uninterrupted or error-free availability.

Early access and waitlist

  1. While the Service is in early access, you may join our waitlist by providing an email address. Waitlist signup is free, creates no obligation to purchase, and does not guarantee a launch date or early-access invitation.
  2. We may end early access, change what is offered before general launch, or remove waitlist entries that appear fraudulent or abusive. You may request removal from the waitlist at any time by contacting [email protected].

Account registration and security

  1. To access the full Service you must create an account with a valid email address and secure password. You agree to provide accurate information and keep it up to date.
  2. You are responsible for maintaining the confidentiality of your credentials, notifying us immediately of any unauthorized access, and all activity that occurs under your account. You may not share your account or create multiple accounts for abusive purposes.
  3. We reserve the right to suspend or terminate accounts for violation of these Terms, fraudulent activity, abuse of the Service, or as required by law.

Subscriptions and payments

  1. The Service may offer free and paid subscription plans. When paid plans are available, all fees will be displayed at checkout and processed securely through Stripe. Billing begins immediately upon subscription unless otherwise stated.
  2. Paid subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. You will be charged the then-current plan price.
  3. We may change subscription prices at any time. For existing subscriptions, price changes will be communicated at least 30 days in advance and take effect at the next renewal, giving you the option to cancel before the new price applies.
  4. Refund policy: Monthly subscriptions are non-refundable for partial months. Annual subscriptions may be refunded on a case-by-case basis within 14 days of initial purchase. For disputed charges, contact [email protected] within 30 days.
  5. You may cancel your subscription at any time via account settings or by contacting support. Upon cancellation, access to paid features continues until the end of the current billing period.

Your content and data

  1. You retain ownership of any content you submit to the Service, such as support messages or feedback. By using the Service you grant us a limited licence to store and process this content solely to provide the Service on your behalf.
  2. You are solely responsible for how you use your study data and pass-readiness scores, and for ensuring your use of the Service complies with applicable laws and any academic or professional honour codes that apply to you.

Intellectual property rights

  1. All practice questions, rationales, scoring methodology, features, and functionality of the NursingExamPro platform are owned by NursingExamPro or its licensors and protected by applicable intellectual property laws. You may not copy, scrape, bulk-download, redistribute, or reverse engineer our question bank or scoring system, or use the platform to build a competing exam-prep service.
  2. Feedback you provide may be incorporated into the Service without compensation or attribution.

Acceptable use policy

  1. You agree not to use the Service to violate applicable laws or regulations, infringe third-party intellectual property rights, scrape or bulk-download the question bank, share account access with others, or misrepresent pass-readiness scores for commercial resale or credential fraud.
  2. You agree not to attempt unauthorized access to other users' accounts, circumvent plan limits or access controls, or use automated tools to extract content from the Service.
  3. Violations may result in a warning, temporary suspension, or permanent termination of your account. Report violations to [email protected].

Third-party services

  1. The Service integrates with Stripe for payment processing and Resend for email delivery, including waitlist and service notifications. Your use of these services is subject to their own terms and privacy policies. We are not responsible for the practices or failures of any third-party service.

Disclaimers and limitations of liability

  1. The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Practice questions, timed tests, and pass-readiness scores are study aids only and do not guarantee that you will pass the PNLE, NCLEX, or any other licensure exam. We do not warrant uninterrupted availability or that content reflects the most current exam blueprints at all times.
  2. To the maximum extent permitted by law, our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or the equivalent of $100 USD in your billing currency. We are not liable for indirect, incidental, or consequential damages including loss of profits, data, or business opportunities.

Indemnification

  1. You agree to indemnify, defend, and hold harmless NursingExamPro and its officers, directors, employees, and agents from any claims, liabilities, damages, and costs (including reasonable attorneys' fees) arising from your use or misuse of the Service, violation of these Terms, or infringement of third-party rights.

Termination

  1. You may terminate your account or remove yourself from the waitlist at any time via account settings or by contacting support. We may terminate or suspend your account immediately, without notice, for breach of these Terms, fraudulent or illegal activity, or at the request of law enforcement.
  2. Upon termination, access to the Service ceases at the end of the current billing period for paid plans. You may request export of your study data or deletion of your account by contacting [email protected].

General provisions

  1. These Terms, together with our Privacy Policy, constitute the entire agreement between you and NursingExamPro. If any provision is found unenforceable, the remaining provisions remain in full effect. We are not liable for failures caused by circumstances beyond our reasonable control. You may not assign these Terms without our prior written consent; we may assign them without restriction.
